End-User Licence Agreement

1. Agreement and licence
This End-User Licence Agreement (“EULA”) is between you and Markitome Private Limited for use of the Digital Army web application, portals, interfaces and related software. By accessing the software, you accept this EULA and the Terms & Conditions. Markitome grants you a limited, revocable, non-exclusive, non-transferable licence to use Digital Army for its intended business or influencer functions.
2. Licence restrictions
You may not copy, sell, sublicense, rent, reverse engineer, decompile, bypass security, probe vulnerabilities, create unauthorised derivative works, automate access contrary to our instructions, or use the software to build a competing service, except to the limited extent such restriction is prohibited by law.
3. Accounts and authorised use
Your licence is tied to your authorised account and role. Influencer, business and administrator access may not be shared with unauthorised persons. You are responsible for devices, connectivity, compatible software and protection of your credentials.
4. Ownership
Digital Army, including its source code, interfaces, databases, workflows, documentation, trademarks and visual assets, is owned by Markitome or its licensors. No ownership rights are transferred to you. Rights not expressly granted are reserved.
5. User and third-party content
You retain rights in content you lawfully submit and grant the operational licence described in the Terms & Conditions. Razorpay, Instagram, Facebook, LinkedIn, X, YouTube and other third-party services are governed by their respective terms. Markitome is not responsible for changes to or availability of those services.
6. Updates, suspension and termination
We may update, modify, replace or discontinue features to improve security, comply with law or operate the service. This licence ends when your account is deleted or terminated. On termination, you must stop using the software; provisions concerning ownership, restrictions, liability and governing law survive.
7. Disclaimer and liability
The software is provided on an “as available” basis. To the maximum extent permitted by law, Markitome disclaims implied warranties and is not liable for indirect, special, incidental or consequential losses. Nothing in this EULA excludes rights or liabilities that cannot lawfully be excluded.
8. Governing law
This EULA is governed by the laws of India. Subject to applicable consumer law, courts at Hyderabad/Secunderabad, Telangana will have jurisdiction. Contact details appear on our Contact Us page.
